Acceptance of Terms

By accessing or using the Gumzo AI platform—including web services, mobile applications, self-hosted deployments, speech transcription, translation, chatbot analysis, and API services (collectively, the "Service")—you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must cease use immediately.

Scope of Service

The Service provides real-time and batch speech-to-text transcription, machine translation, LLM-powered chatbot analysis, and a programmable API. These Terms govern all interactions, whether via web, mobile application, self-hosted deployment, or API access.

Permitted Use

Subject to these Terms, Gumzo AI grants you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, including:

  • Submitting audio/text for transcription and translation
  • Interacting with our chatbot analysis interface
  • Invoking the API to integrate services into your applications
  • Retrieving and managing results via web dashboard or API
  • Using our mobile applications for on-the-go processing
  • Deploying self-hosted versions in air-gapped environments

API License & Usage

Your API key is personal, non-transferable, and for your use only. You must:

  • Keep your API credentials secure and confidential
  • Not exceed your subscription's rate limits
  • Use the API solely for lawful and authorized purposes
  • Comply with our published API documentation
  • Note that API access is not available for self-hosted air-gapped deployments

Registration & Accounts

  • You must provide accurate, complete, and current information when registering
  • You are responsible for safeguarding your credentials and any activity under your account
  • You must notify us immediately of any unauthorized use or breach of security
  • Mobile app users may access services using the same account credentials
  • Self-hosted deployments require separate offline license activation

Subscriptions & Payments

Access to premium and API services requires a paid subscription. Self-hosted deployments require a separate enterprise license. All fees are:

  • Billed in advance and non-refundable
  • Subject to change upon 30 days' notice
  • Exclusive of applicable taxes which remain your responsibility
  • Covered by different pricing models for mobile, cloud, and self-hosted deployments

Deployment Options

AMobile Applications

  • Available on iOS and Android platforms
  • Requires internet connection for cloud-based processing
  • Offline capabilities limited to pre-downloaded models
  • Subject to app store additional terms and conditions
  • Mobile-specific features include voice command integration

BSelf-Hosted Deployment

  • For air-gapped/offline environments with no external connectivity
  • Requires enterprise license agreement with annual subscription
  • Includes on-premises speech recognition engine with local processing
  • Customer responsible for hardware and infrastructure requirements
  • No automatic updates - manual patching required
  • Support provided through separate SLA agreement
  • Data remains exclusively within customer-controlled environment
  • Minimum system requirements: 8-core CPU, 32GB RAM, NVIDIA GPU recommended

Customer Data & AI Training

You retain ownership of all content you submit. By using the Service:

  • You grant Gumzo AI a limited license to process, store, and display your content for service provision
  • Cloud deployments: Data may be anonymized and aggregated for model improvement
  • Self-hosted deployments: Data never leaves your infrastructure unless explicitly exported
  • No identifiable customer data will be used for training unless you explicitly opt in
  • Mobile app data follows cloud deployment policies unless using offline mode
  • Self-hosted customers can perform local model training with their data

Intellectual Property

  • All software, algorithms, and models are owned by Gumzo AI
  • Self-hosted deployments receive limited, non-transferable usage rights
  • Mobile applications are licensed, not sold
  • You may not reverse engineer, decompile, or disassemble any components
  • Model weights and architecture remain Gumzo AI proprietary information
  • Self-hosted customers receive object code only, no source code access

Prohibited Conduct

You agree not to:

  • Use the Service to infringe others' rights or violate any law
  • Upload harmful code or malicious data
  • Bypass or defeat access controls or rate limits
  • Redistribute self-hosted software beyond licensed installations
  • Attempt to extract model weights from self-hosted deployments
  • Use mobile apps in violation of app store policies
  • Modify or tamper with self-hosted software integrity checks

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT.

SELF-HOSTED DEPLOYMENTS: GUMZO AI DISCLAIMS ALL LIABILITY FOR HARDWARE FAILURE, NETWORK CONFIGURATION, OR CUSTOMER INFRASTRUCTURE ISSUES. MOBILE APPLICATIONS: PERFORMANCE VARIES BY DEVICE CAPABILITY AND NETWORK CONDITIONS. ACCURACY OF SPEECH RECOGNITION VARIES BASED ON AUDIO QUALITY AND BACKGROUND NOISE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUMZO AI'S LIABILITY IS LIMITED TO THE AMOUNTS YOU HAVE PAID IN THE PRIOR SIX MONTHS. FOR SELF-HOSTED DEPLOYMENTS, LIABILITY IS LIMITED TO THE ANNUAL LICENSE FEE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO DATA LOSS, SECURITY BREACHES IN CUSTOMER ENVIRONMENTS, OR MOBILE DEVICE FAILURES.

Indemnification

You agree to indemnify and hold harmless Gumzo AI, its affiliates, officers, and employees from any claims, damages, or losses arising out of your use of the Service, including but not limited to mobile app usage, API integrations, or self-hosted deployment configurations.

Termination

  • We may suspend or terminate access for violation of these Terms
  • Self-hosted licenses terminate upon expiration without renewal
  • Upon termination, you must uninstall all software components
  • Mobile app subscriptions follow platform billing cycles
  • Self-hosted customers must provide certificate of software deletion

Changes to Terms

  • We may update these Terms periodically
  • Changes communicated via email or website notice 30 days in advance
  • Self-hosted customers receive change notices through support channels
  • Mobile app users notified through app update mechanisms
  • Continued use after effective date constitutes acceptance
  • Material changes to self-hosted terms require 60 days notice

Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Kenya. You may bring any dispute in your local courts or in Kenya, at our election. Self-hosted license agreements may specify alternative jurisdiction.
